Letter of No Objection
All domestic regulated entities are required to comply with the provisions of La. R.S. 22:41.3. This statute became effective August 1, 2021, but the requirement was previously contained in LAC37:XXIII. Chapter 5L (Regulation 66). This includes all domestic insurers, third party administrators, mutual holding companies and other entities which are licensed, registered or certified by the Louisiana Department of Insurance. The definition does NOT include insurance agencies, producers or adjusters.
Prior to serving as an officer, director or trustee of a domestic regulated entity, an individual must submit certain items to the Louisiana Department of Insurance in support of a request for a letter of no objection. The request must be submitted no more than thirty days from the date of election or appointment as an officer, director or trustee.
The Louisiana Department of Insurance (LDI) accepts electronic submission of the application. The applicant should contact the LDI prior to submission to make arrangements for a secure portal for such a submission. Submission of sensitive or confidential information via standard email is not recommended.
