Hurricane Mediation Program

Purpose
The Hurricane Mediation Program was established January 1, 2023, by Act 591 of the 2022 Regular Session of the Louisiana Legislature (now codified as La.R.S. 22:2651, et. seq.). The Mediation Program was established to provide property owners with an option to settle insurance claims in an inexpensive and timely manner.
Mediation Requests
Every policyholder may request mediation under the following conditions:
- The governor has declared a state of emergency per La. R.S. 29:724 for a named windstorm event,
- A policyholder has submitted a residential property insurance claim for damage to a property located within the geographic area subject to the declared state of emergency, AND
- The related property damage claim involves disputed amounts up to $150,000. For claims with disputed amounts over $150,000, a policyholder and insurer may agree to mediate and be subject to the provisions of La. R.S. 22:2651, et. seq.
Once a policyholder has made the decision to participate in the Mediation Program, he or she must contact one of the participating mediation firms listed on the LDI website.
Mediation Process
Mediation firms interested in applying for consideration to be added to the LDI’s list of approved mediation firms must read and ensure compliance with the following requirements before applying:
- Mediation Firm requirements: La. R.S. 22:2654.
- Insurer and Insured Requirements for Mediation: La. R.S. 22:2655.
- Alternative Dispute Resolution Disclosure Notice: La. R.S. 22:2656.
- Title 37 Part XIII Chapter 195 Regulation 127.
Application Process
Mediation firms seeking to be added to the LDI Approved Mediation Firm List must:
- Meet all of the mediator qualifications found in La. R.S. 9:4106,
- Agree to apply to the professional conduct of mediators per La. R.S. 9:4107,
- Agree to comply with La. R.S. 2651 et. seq. and Regulation 127, and
- Submit a request for application to the LDI through the link below.
